Staffing has been an ongoing issue in the long-term care system and studies show it significantly contributes to quality of care. A <a href=\"https:\/\/www.nytimes.com\/2021\/12\/09\/business\/nursing-home-abuse-inspection.html\" target=\"_blank\" rel=\"noopener\">2021 investigation<\/a> conducted by <em>The <\/em><em>New York Times<\/em> found that over 2,700 dangerous incidents were not factored into the CMS Rating System. CMS has been working to attempt improvements to this rating system and has current plans of another update in April 2024.<\/p><p>\u00a0<\/p><p>When possible, it is best to visit a facility prior to transfer or admission. If you or the individual are in the hospital, ask hospital staff like nurses for their opinions. Nurses and physicians often see many residents from care facilities and may have insight from their experiences. If you visit facilities, try to ask any visitors you see about the facility.<\/p><p>\u00a0<\/p><p>Make observations of what is occurring at the facility when you visit, in addition to the state of This reform states that facilities should promote residents&#8217; quality of life;\u00a0 resident health and quality of life should not decline due to care provided by the facility.\u00a0<\/p><p>\u00a0<\/p><p>Below are noteworthy excerpts of nursing home requirements put in place by the NHRA. (This is not a complete list):<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e3a4784 elementor-widget elementor-widget-text-editor\" data-id=\"e3a4784\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ol><li>&#8220;<strong>Provide services and activities to attain or maintain the highest practicable physical, mental, and psychosocial well-being of each resident in accordance with a written plan of care<\/strong> which&#8211;<\/li><\/ol><p style=\"padding-left: 40px;\"><strong>(A)<\/strong> describes the medical, nursing, and psychosocial needs of the resident and how such needs will be met; is initially prepared with the participation to the extent practicable of the resident or the resident&#8217;s family or legal representative<\/p><p style=\"padding-left: 40px;\"><strong>(B)<\/strong> is initially prepared, with the participation to the extent practicable of the resident or the resident\u2019s family or legal representative, by a team which includes the resident\u2019s attending physician and a registered professional nurse with responsibility for the resident; and<\/p><p class=\"subpara\" style=\"padding-left: 40px;\"><strong>(C)<\/strong> is periodically reviewed and revised by such team after each assessment under paragraph (3)&#8221;<\/p><p>\u00a0<\/p><p>2. &#8220;<strong>A nursing facility must conduct a comprehensive, accurate, standardized, reproducible assessment of each resident\u2019s functional capacity, which assessment<\/strong>\u2014<\/p><p style=\"padding-left: 40px;\"><strong>(i)<\/strong> describes the resident\u2019s capability to perform daily life functions and significant impairments in functional capacity;<\/p><p style=\"padding-left: 40px;\"><strong>(ii)<\/strong> is based on a uniform minimum data set specified by the Secretary under subsection (f)(6)(A);<\/p><p class=\"clause\" style=\"padding-left: 40px;\"><strong>(iii)<\/strong> uses an instrument which is specified by the State under subsection (e)(5); and<\/p><p class=\"clause\" style=\"padding-left: 40px;\"><strong>(iv)<\/strong> includes the identification of medical problems.&#8221;<\/p><p>\u00a0<\/p><p>3.<span style=\"color: #000000;\"><strong> &#8220;Such an assessment must be conducted\u2014<\/strong><\/span><\/p><p style=\"padding-left: 40px;\"><strong>(I)<\/strong> promptly upon (but no later than not later than 14 days after the date of) admission for each individual admitted on or after October 1, 1990, and by not later than October 1, 1991, for each resident of the facility on that date;<\/p><p style=\"padding-left: 40px;\"><strong>(II)<\/strong> promptly after a significant change in the resident\u2019s physical or mental condition;
